Mediation and Arbitration - ADR Training - Sydney

This interactive and practical program is designed to give participants the knowledge and skills required to practice Family Law mediation with confidence and professionalism.

3 x pre-recorded Webinars are required viewing before the course.  

The onsite Course will run over 3.5 days— Tuesday 30 October, Wednesday 31 October, Thursday 1 November with assessment on Friday 2 November.

Over the course of the program, participants will:

  • become familiar with the AIFLAM model of family law property mediation
  • engage in role-plays both as a mediator and as a party to experience fully the dynamics of mediation
  • develop skills in facilitating negotiation and problem-solving between the parties
  • develop proficiency in managing a mediation process and, at the end of the course, should be able to mediate family property and other disputes competently (excluding disputes involving children, which requires additional FDRP training)
  • develop a capacity to critically reflect on their own practice of mediation
  • develop a capacity to critically reflect on which mediator interventions work and when.

As well as training in the AIFLAM mediation model, to comply with the NMAS, the course content will also include:

  • preparation and dispute diagnosis in mediation
  • communication patterns in conflict and negotiation situations
  • negotiation dynamics in mediation
  • potential responses to high emotion, power imbalances and violence
  • pre-mediation preparation, screening and intake
  • an understanding of the ethical and practical issues that arise in mediation
  • confidentiality, enforceability of mediated agreements and liability of mediators
  • cross-cultural issues in mediation and dispute resolution, and
  • the roles and functions of support persons, lawyers and other professionals in mediation.

Arbitration is an alternative dispute resolution (ADR) process in which parties refer their dispute to an independent third person who can make a binding decision.  The program is interactive and practical and designed to show participants the knowledge and skills required to conduct Family Law Arbitration with confidence and professionalism.

Over the course of the program, participants will:

  • Become familiar with the AIFLAM styles and processes of arbitration
  • Discover the essentials of arbitration—what it is and what it is not, the rules and statutory basis of Family Law Arbitration and how it fits into the family law dispute resolution system.
  • Undertake role-plays as an arbitrator to experience the dynamics of arbitration
  • Develop skills in conducting arbitration, including how to prepare for arbitration, award writing, and managing the arbitration process

 This course is open to AIFLAM Members and Members of the Legal Profession generally.  

Pursuant to the Family Law Regulations1984, prerequisites for attending the course are that you are a legal practitioner, and either:

a) you have practiced for at least 5 years with at least 25% of your work in that time being in relation to family law matters; or

b) you are accredited as a family law specialist by a State or Territory legal professional body.

AIFLAM prefers that participants have completed the AIFLAM mediation training program before completing the arbitration component.  However, this is not a pre-requisite.

Successful completion of the course will entitle attendees to be listed as a Family Law Arbitrator pursuant to Regulation 67B of the Family Law Regulations.

Having regard to those requirements, when enrolling you will be asked to provide us with the following current information/documents: -

  • Date of admission
  • Statutory Declaration that you have practiced for at least 5 years with at least 25% of your work in that time being in relation to family law matters, or a copy of your current certification as an Accredited Specialist in family lawyer from a State or Territory legal professional body
  • Evidence of Current Professional Indemnity Insurance cover.
